1. Introduction

These Terms of Service (“Terms”) govern your access to and use of hardmoneylendersoflosangeles.com (the “Site”), which is (“Hard Money Lenders of Los Angeles,” “we,” “us,” or “our”). By accessing the Site, submitting an inquiry, or otherwise using the services made available through the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Our Role: a lender

Hard Money Lenders of Los Angeles operates this Site as a lender that finances consumers interested in hard money financing directly who may be able to provide that financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including whether to offer financing and on what terms, are the sole responsibility of us.

References on the Site to loan programs, rates, terms, timelines, or funding are references to programs offered by our lending team and are subject to change without notice. Not all applicants will qualify. Current loan program details are available upon request.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer to lend, a commitment to lend, or a solicitation to enter into any financing transaction. Information displayed on the Site is for general informational purposes only and does not create any binding obligation on Hard Money Lenders of Los Angeles or any our lending team. Any financing offer you receive will come directly from our lending team and will be governed by that lender’s own application, underwriting, and loan documents.

4. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. You agree to provide accurate, current, and complete information in any inquiry you submit, and to promptly update that information if it changes.

5. Your Consent to Be Contacted

By submitting an inquiry and checking the consent box on our contact form, you provide your prior express written consent for our lending team to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You acknowledge that your information will be shared directly who may contact you. Consent is not a condition of receiving any services or obtaining a loan.

Message and data rates may apply, and message frequency varies. You can opt out of text messages at any time by replying STOP. You can opt out of phone calls by telling the caller, and you can opt out of marketing email by using the unsubscribe link in any email or contacting us at [email protected]. Opting out of contact by Hard Money Lenders of Los Angeles does not automatically opt you out of contact by our lending team who has already received your information; you will need to contact that lender directly.

our lending team in our network are Equal Opportunity Lenders. They do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
• Submit false, misleading, or fraudulent information, or information about any person other than yourself without their authorization;
• Attempt to probe, scan, or test the vulnerability of the Site, breach security or authentication measures, or interfere with other users’ use of the Site;
• Use automated means (including bots, scrapers, or crawlers) to access or collect data from the Site except as expressly permitted; or
• Attempt to reverse engineer, copy, or otherwise misuse any portion of the Site or its underlying technology.

8. Intellectual Property

The Site, including its text, graphics, logos, images, and software, is owned by or licensed to Hard Money Lenders of Los Angeles and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any portion of the Site without our prior written consent, except as permitted by these Terms or applicable law.

9. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources, including those operated by our lending team. We do not control those third parties and are not responsible for their content, products, services, or privacy practices. Your use of any third-party site or service is at your own risk and subject to that third party’s terms and privacy policy.

10. Disclaimers

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Hard Money Lenders of Los Angeles disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that any information on the Site is accurate, complete, or current.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will Hard Money Lenders of Los Angeles or its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, whether based in contract, tort, statute, or otherwise, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Hard Money Lenders of Los Angeles and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. You agree that any action arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Site after any change means you accept the updated Terms.
